If you are hurt in an accident at work in Poland, or develop an occupational disease, ZUS can pay a one-off compensation (jednorazowe odszkodowanie) for the lasting damage to your health. From 1 April 2026 to 31 March 2027 it is 1,781 zł for each percent of permanent or long-term health damage. This guide follows the ZUS service page and the ZUS page with the current amounts, which cites the Ministry of Family notice of 10 March 2026 (Monitor Polski 2026 item 292). It explains who is entitled, what documents are needed and how long the procedure takes.

The amounts from 1 April 2026

According to ZUS, the amounts for the period from 1 April 2026 to 31 March 2027 are:

  • 1,781 zł for each percent of permanent or long-term health damage
  • 1,781 zł for each percent of the added damage, where the damage grew by at least 10 percentage points
  • 31,162 zł for a ruling of total inability to work together with inability to live independently
  • 160,264 zł where the spouse or a child of a deceased insured person or pensioner is entitled
  • 80,132 zł where a family member other than the spouse or a child is entitled

For several entitled family members the notice sets add-ons: for example 160,264 zł where a spouse and one or more children are entitled together, plus 31,162 zł for each child, and 31,162 zł for each other family member alongside a spouse or children. As an example of how the main rule works, 10% of permanent damage gives 17,810 zł (our calculation, 10 x 1,781 zł).

ZUS also explains that the benefit depends on the degree of bodily impairment and equals 20% of the average monthly wage for each percent of permanent or long-term damage. The yearly notice turns this into the zloty amounts above.

Who is entitled

ZUS lists two groups:

  • a person who suffered permanent or long-term damage to health as a result of an accident at work or an occupational disease
  • an entitled family member of a person who died because of an accident at work or an occupational disease: the spouse, children (own, the spouse's, adopted), grandchildren, siblings and other children taken in for upbringing before they came of age, and parents

What documents are needed

For the injured person:

  • the application for one-off compensation
  • the OL-9 health certificate with information on the finished treatment and rehabilitation, issued no earlier than one month before filing, and medical documentation if relevant
  • the accident report prepared by the employer, or the accident card
  • a final judgment of the labour court, or the decision on an occupational disease issued by the state sanitary inspector, depending on the case

For compensation after a death, documents include the dates of birth and death, proof of kinship, a short copy of the marriage certificate for a widow or widower, a child's health certificate where entitlement depends on inability to work, school attendance certificate for a child over 16 and, for some parents and step-parents, a maintenance document.

When and where to apply

You apply after the treatment and rehabilitation have ended. For compensation after a death, you can apply at any time.

The application is filed through the contribution payer (usually the employer). People running a non-agricultural business, nannies working under an activating contract, and cases of a closed-down workplace file differently: in person or by an attorney at any ZUS unit, in writing or orally for the record, or via a postal operator or a Polish consulate.

How long it takes

The responsible ZUS office decides. A decision on the right and the amount is issued within 14 days of the date the ZUS certifying doctor's ruling becomes final or the medical commission's ruling is received, or from clarifying the last circumstance needed. If compensation is granted, it is paid within 30 days of the decision.

If you disagree

You can appeal in writing or orally for the record, through the ZUS unit that issued the decision, to the regional court (labour and social insurance court), within one month of receiving the decision. The appeal proceedings are free of charge.

When compensation is not paid

ZUS says it is not paid to an insured person if:

  • the sole cause of the accident was a proven violation of health and safety rules by the insured, caused intentionally or through gross negligence
  • the insured, being drunk or under the influence of drugs or psychotropic substances, contributed to the accident to a significant degree

These two exclusions do not apply to accidents with a fatal result.

For people running a non-agricultural business, their cooperating persons and clergy paying their own contributions, benefits are not due while there is a debt in social insurance contributions on the day of the accident, or on the day the occupational disease application is filed, until the whole debt is paid. The right expires if the debt is not paid within 6 months.

What the ZUS page does not say

The ZUS page does not discuss foreign workers separately. The compensation is tied to being insured for accidents at work, so a foreign employee covered by Polish social insurance should ask ZUS or the employer how the rules apply to their case.
