Can Your Employer Fire You in Poland? Notice and Protections
The essentials: Yes, but under strict rules: notice of two weeks to three months by tenure, a written reason, protection during pregnancy, parental leave, holidays and within four years of retirement, severance in layoffs, and 21 days to appeal to the labour court.

Losing a job abroad is stressful enough without guessing your rights. Polish law gives employees some of Europe's more structured dismissal protections: mandatory notice periods, written justification, protected groups who effectively cannot be fired, severance pay in layoffs, and a labour court that hears appeals for a symbolic fee. Here is how it works in 2026.
First: are you an employee at all?
Every protection in this article applies to people on an employment contract (umowa o prace) under the Labour Code. If you work on a civil contract (umowa zlecenie) or B2B, your notice and severance terms are whatever the contract says - the statutory rules below do not apply, which is exactly why misclassifying employees as contractors is the most common labour dispute in Poland.

Notice periods: two weeks to three months
Either side can end an employment contract with notice, and the period depends on your tenure with that employer, counting previous employment that transferred under business-takeover rules:
- 2 weeks - under six months of employment;
- 1 month - at least six months;
- 3 months - at least three years.
These periods apply equally to fixed-term and indefinite contracts. Probationary contracts have shorter notice - three working days to two weeks depending on the probation length.

The written-reason requirement
A Polish dismissal is not valid as a casual conversation. The employer's notice must be in writing, must state the reason justifying it, and must include information about your right to appeal to the labour court. The reason must be concrete and real - vague dissatisfaction is not a legal ground. If the letter lacks a reason, the notice is defective and challengeable.
For employees on indefinite contracts there is an additional layer where a union operates: the employer must notify the workplace union of the intent to dismiss, and for union officials and certain protected representatives, dismissal requires the union board's consent.

Who cannot be fired
Several groups enjoy near-absolute protection against notice:
- Pregnancy and parental leaves: from the day you apply for maternity, paternity or parental leave until it ends, the employer cannot even prepare to dismiss you, let alone deliver notice.
- Pre-retirement: employees within four years of retirement age cannot be given notice if their tenure lets them reach pension rights.
- During leave: no notice can be served while you are on holiday or other justified absence, if the deadline to dismiss without notice has not yet passed.
- Union officials and employee-council members during their mandate.
Fixed-term and probationary contracts can still be ended when they expire; the protections target termination by notice.

Severance pay in layoffs
When a company employing at least 20 people dismisses staff for reasons not concerning the employees - restructuring, redundancy, closure - whether individually or in a group, dismissed employees receive statutory severance: one month's pay with under two years of tenure, two months' pay between two and eight years, three months' pay above eight years, calculated like holiday compensation.

Instant dismissal and quitting with cause
An employer can terminate immediately, without notice, only for serious reasons: a grave breach of basic duties, a crime making continued employment impossible, or losing qualifications needed for the job. Missing work through illness is never such a reason. The reverse also exists: you can quit without notice if the employer seriously breaches its duties - for example, persistent unpaid wages - with compensation equal to the notice period.

Probation and fixed-term specifics
Probationary contracts follow their own shorter ladder: three working days' notice if the probation runs up to two weeks, one week if it runs longer, and two weeks for a three-month probation. Fixed-term contracts end automatically at their term without any notice at all - the employer owes you neither a reason nor severance, which is why the 33-month and three-contract limits on fixed terms matter so much. One trap to know: illness is never a ground for instant dismissal, and even long sick leave only lets the employer terminate without notice after three months of absence, or one month if you have worked there over six months and the illness began after that tenure.

During the notice period
Notice time works for you, not just the employer. You keep full pay and duties unless the employer releases you from working - a common practice - while pay continues regardless. You are also entitled to paid time off to job-hunt: two working days during a notice of up to one month, three working days during a three-month notice. At the end, the employer must hand over your employment certificate immediately, pay out unused holiday as cash compensation, and deregister you from ZUS within seven days.

Challenging a dismissal
You have 21 days from receiving the notice to appeal to the labour court (sad pracy). The burden of proving the stated reason was concrete, real and sufficient falls on the employer - not on you. If the court finds the dismissal unlawful or unjustified, it can order reinstatement to your old position or award compensation of between two weeks' and three months' full pay. Filing is cheap by design - labour-court fees for employees are symbolic - and unions, the National Labour Inspectorate (PIP) and municipal free legal-aid points can help prepare the case.
Two related claims are worth knowing. If the dismissal followed bullying or harassment, Polish law recognises mobbing as a ground for compensation of not less than the minimum monthly wage, on top of any dismissal claim. And if you were let go for a discriminatory reason - age, sex, disability, religion, union activity - equal-treatment rules give you a separate damages claim regardless of the notice formalities.

A word on "mutual agreements"
Employers often propose ending the contract by mutual agreement (porozumienie stron) instead of notice. It is faster for everyone, but it trades away your leverage: no stated reason is needed, no severance is automatic, and unemployment-office formalities treat it more like quitting. You can negotiate - many employees trade a signature for extra months of pay or a longer run-out - but once signed, it is very hard to undo. Never sign in the meeting where it is first proposed.

Practical tips
- Never sign a "mutual agreement" (porozumienie stron) on the spot - it usually waives the protections described here; take it home first.
- Check the written reason: no stated reason means a defective notice.
- Calendar the 21-day appeal deadline the day you receive notice.
- Ask HR for the employment certificate (swiadectwo pracy) - the employer must issue it.
- Unused holiday converts to cash compensation (ekwiwalent) on your final payslip.
- If you are on a zlecenie doing employee-style work, a labour court can reclassify the relationship retroactively.
- Photograph or forward to a private account anything you might later need - access to company email usually dies the day notice lands.
- Unemployment benefit (zasiłek) requires registering at the district labour office within seven days of the contract ending.
