A tax office building in Lublin - Polish sole traders choose between the tax scale, the 19% flat tax and ryczałt on revenue

Registering a one-person business (JDG) in Poland takes minutes; choosing how it is taxed shapes your bills for years. Polish law gives sole traders three main income-tax forms - the progressive scale, the 19% flat tax and the revenue-based ryczałt - each with different rates, deduction rights and even different health-insurance contributions. This guide compares them with the 2026 figures from podatki.gov.pl and ZUS.

The three forms at a glance

Skala podatkowa (tax scale, "general rules"). The default: no election needed. You pay 12% on taxable income up to 120,000 zł (minus the 3,600 zł tax-reducing amount, which effectively makes the first 30,000 zł tax-free) and 32% on the excess. Tax base is income - revenue minus documented costs.

Podatek liniowy (flat tax). A flat 19% on income (revenue minus costs), regardless of how much you earn. You must file a declaration with your tax office head by the 20th day of the month after the month of your first revenue in the year, or by year-end if your first revenue comes in December.

Ryczałt od przychodów ewidencjonowanych (flat rate on recorded revenue). Tax on revenue only - no cost deduction - at rates from 3% to 17% depending on the type of activity (17%, 15%, 14%, 12.5%, 12%, 10%, 8.5%, 5.5% and 3% exist on the official list). Election deadline matches the flat tax: the 20th of the month after your first revenue.

Who can use which form

The scale is open to everyone. The flat tax is barred if you provide services to your current or former employer in the same year and in the same scope as your employment duties. Ryczałt has its own exclusion list in the lump-sum act: pharmacies, currency-exchange trading, trade in vehicle parts and accessories, production of excise goods (renewable electricity excepted), and selling goods or services to a current or former employer that match what you or your partner did as an employee are all excluded.

Ryczałt also has a revenue ceiling: for 2026, your 2025 business revenue must not exceed 2,000,000 euro, which the Finance Ministry converts to 8,517,200 zł. Quarterly ryczałt payments are available if 2025 revenue stayed under 200,000 euro (851,720 zł for 2026). New businesses can choose ryczałt from day one.

Deductions and reliefs: where the scale wins

The scale keeps the full menu: preferential joint filing with a spouse, single-parent filing, and the standard catalogue of reliefs and deductions. The flat tax gives up joint filing and most reliefs, though it still allows, among others, social-insurance contribution deductions, health-contribution deductions within the statutory limit, IKZE retirement contributions, the R&D relief and a few others. Ryczałt blocks cost deduction and most reliefs but still lets you deduct social-insurance contributions, 50% of paid health contributions, IKZE contributions and the thermomodernisation relief.

The health contribution can outweigh the tax

Since the Polish Deal reform, your ZUS health-insurance contribution depends on the tax form, and ZUS confirms the 2026 figures:

  • Scale: 9% of the contribution base (income), no deduction against tax.
  • Flat tax: 4.9% of income, with a statutory monthly minimum of 432.54 zł in 2026.
  • Ryczałt: fixed monthly amounts by annual revenue band: 498.35 zł, 830.58 zł or 1,495.05 zł in 2026.

A high-revenue, low-margin business on ryczałt pays the top band even in a loss-making month; a low-income flat-taxed freelancer still owes the 432.54 zł minimum. Run both taxes and the health contribution before choosing.

Paperwork and payment rhythm

Scale and flat tax require the revenue-and-expense ledger (PKPiR) or full accounting books; ryczałt requires a simpler revenue record split by rate, under the Finance Ministry regulation of 17 December 2021. Advances (or ryczałt payments) go to the tax office by the 20th of each month for the previous month, and are only mandatory once the computed advance exceeds 1,000 zł. New businesses can pay quarterly; the annual returns - PIT-36 (scale), PIT-36L (flat tax), PIT-28 (ryczałt) - are filed between 15 February and 30 April.

Which form suits which expat freelancer?

There is no universal winner, but the official rules point to typical fits:

  • Low costs, high margin, simple services (IT, design, consulting): ryczałt can be cheapest - a 12% or 8.5% rate on revenue with modest bookkeeping - if your activity has a favourable rate and you do not serve a former employer.
  • Significant real costs (equipment, subcontractors, rent): the flat tax or scale, because ryczałt ignores costs entirely.
  • Moderate income, family reliefs, joint filing with a spouse: the scale, the only form that preserves the full relief catalogue and the 30,000 zł tax-free amount.
  • Parallel employment with your own former employer as client: both the flat tax and ryczałt are restricted; check the same-scope rules first.

Frequently asked questions

Can I change the tax form later?

Yes, between years: you elect the flat tax or ryczałt for the coming year by declaring it to your tax office head by the 20th of the month after your first revenue of that year. The scale needs no declaration - it applies by default.

Does ryczałt really ignore all my costs?

For income tax, yes - tax is computed on revenue. But you can still deduct social-insurance contributions, 50% of health contributions paid, IKZE contributions and the thermomodernisation relief.

What are the ryczałt revenue limits for 2026?

Your 2025 revenue must be at most 2,000,000 euro (8,517,200 zł) to use ryczałt in 2026, and at most 200,000 euro (851,720 zł) to pay quarterly rather than monthly.

Which annual return do I file?

PIT-36 for the tax scale, PIT-36L for the flat tax and PIT-28 for ryczałt, all between 15 February and 30 April of the following year. * Photo (cover): "Drugi Urzad Skarbowy w Lublinie" by Tomasz Zugaj, CC BY-SA 4.0, via Wikimedia Commons.
