Maternity, Parental and Paternity Leave in Poland: Length and Pay
Short answer: Maternity leave is 20 weeks (longer for multiples), parental leave 41 or 43 weeks shared between parents with 9 non-transferable weeks each, and paternity leave 2 weeks. ZUS pays 100% for maternity and paternity leave, 70% for parental, or 81.5% on the combined option.

Having a baby while working in Poland comes with a layered system of leave that confuses even locals: maternity leave, parental leave and paternity leave are three separate entitlements with different lengths, different pay rates and different rules about who can take them. For expat employees the good news is that these are Labour Code rights tied to your job, not to citizenship. Here is the full picture, based on the Labour Ministry's official pages and ZUS benefit rules, as of 14 October 2026.
Maternity leave: 20 weeks, mostly for the mother
Maternity leave (urlop macierzyński) is obligatory for every female employee who gives birth, regardless of her type of employment contract. The length depends on the number of children born at once: 20 weeks for one child, 31 for twins, 33 for triplets, 35 for quadruplets and 37 for five or more. Up to six weeks can be used before the due date, and after the birth at least 14 weeks are mandatory for the mother.
The remaining weeks can be transferred: a mother who has used her compulsory 14 weeks may return to work and hand the rest of the maternity leave to the child's father or another close family member who is an employee. During pregnancy and maternity leave, and from the moment the leave application is filed, the employer generally cannot dismiss the employee at all, except in narrow cases such as company bankruptcy.
Parental leave: 41 or 43 weeks to share
Parental leave (urlop rodzicielski) follows maternity leave and belongs to both parents together: 41 weeks for a single birth, 43 for a multiple birth. Parents of a child with a "Za życiem" certificate get 65 or 67 weeks respectively. Parents can take it at the same time, but their combined use cannot exceed the total pool.
The rule that changed parental behaviour in Poland: nine weeks of the pool are reserved exclusively for each parent and cannot be transferred. A father who takes at least his nine weeks uses his non-transferable part; if he never takes it, those weeks are simply lost. Parental leave can be split into at most five parts and used until the end of the calendar year in which the child turns six, and it can be combined with part-time work (up to half-time), which extends the leave proportionally. Applications go to the employer at least 21 days ahead and are binding: the employer must grant them.

Paternity leave: the father's own two weeks
Separate from everything above, paternity leave (urlop ojcowski) is the father's exclusive, independent right: up to two weeks, taken no later than the child's first birthday, in one block or two parts of at least a week each. The application goes in at least seven days before the start, and from that moment until the leave ends the father is protected from dismissal. This right exists even if the mother is not an employee and has no leave of her own.
What ZUS pays during leave
Pay during these leaves comes as the maternity benefit (zasiłek macierzyński) from social insurance, not from the employer's pocket. According to ZUS, the rates are:
- 100% of the benefit base for the maternity-leave and paternity-leave periods
- 70% of the base for the parental-leave period
- an 81.5% flat rate for the whole package if the mother applies within 21 days of the birth for maternity and parental leave together (the other parent's nine-week non-transferable part stays at 70%)
There is a built-in correction: if the family ends up using no parental-leave benefit in the child's first year, the maternity benefit is topped up retroactively to 100%. The benefit base is generally your average social-insurance salary, which is why the scheme matters most to people on employment contracts and others covered by sickness insurance, including voluntarily insured contractors and business owners.
What foreign parents should check
The leave rights attach to the employment relationship, so a foreign employee on a Polish contract has the same entitlements as a Polish colleague. The benefit side runs through social insurance: employees are insured by default, while umowa zlecenie contractors and B2B freelancers are covered only if they pay voluntary sickness contributions. If your family situation spans two countries, the details of which state's system pays can get complicated, so confirm your case with ZUS before the birth rather than after.
Frequently asked questions
### Can a foreign father take paternity leave in Poland?
Yes. Paternity leave is a Labour Code right of every employee-father, regardless of citizenship: two weeks within the child's first year, in up to two parts, with dismissal protection from the day the application is filed.
How much is paid during parental leave?
The ZUS maternity benefit pays 70% of the benefit base for parental leave, 100% for maternity and paternity leave, or a flat 81.5% for the combined package if the mother applies within 21 days after the birth.
Can both parents be on parental leave at the same time?
Yes. Both parents may use parental leave simultaneously, but their combined weeks cannot exceed the total 41 or 43 weeks, and each parent has nine weeks that only they can use.
Until when can parental leave be used?
In up to five parts, no later than the end of the calendar year in which the child turns six.
