Polish Income Tax (PIT) 2026: Rates, Tax-Free Amount and Filing

Short answer: Polish employment income is taxed at 12% up to 120,000 zl (minus a 3,600 zl reducer, making the first 30,000 zl tax-free) and 32% above. File PIT-2 to cut monthly advances by 300 zl; joint spousal filing and a 4% levy above 1M zl also apply.

Poland's personal income tax (PIT) looks simple from a distance - two main rates - but the way the tax-free amount, monthly advances and a handful of flat rates interact catches out a lot of newcomers. This guide walks through the rules the Ministry of Finance published for 2026 (page updated 15 December 2025), so you know what should be coming off your payslip and what lands in your annual return.

The 2026 tax scale at a glance

Employment income, civil-law contracts and most pension income are taxed on the progressive scale:

  • Up to 120,000 zł of annual tax base: 12%, minus a tax-reducing amount of 3,600 zł
  • Above 120,000 zł: 10,800 zł plus 32% of the excess over 120,000 zł

The tax base is your income after deductible costs and social-security contributions, not your gross salary. The scale has been unchanged since 2022.

The 30,000 zł tax-free amount

Poland does not apply the tax-free amount as a separate line. It is built into the scale through the 3,600 zł reducer: 12% of 30,000 zł is exactly 3,600 zł, so the first 30,000 zł of annual tax base is effectively tax-free. If your yearly income stays under that, your annual PIT works out to zero - though advances may still have been collected during the year and come back as a refund.

How it reaches your payslip

Your employer withholds a monthly advance. By default the advance ignores the reducer, which is why filing a PIT-2 declaration matters: it tells your payer to apply 1/12 of the 3,600 zł - 300 zł per month - against your advances. If you have more than one payer (two jobs, or a job plus a pension), you can split the reducer: 1/24 (150 zł) with two payers or 1/36 (100 zł) with up to three, using PIT-2, PIT-2A or PIT-3 as appropriate. The amounts even out in the annual return; PIT-2 only changes cash flow during the year.

After the year ends you settle up in an annual return - for most employees that is PIT-37, usually through the Twój e-PIT online service.

Income taxed at flat rates instead

Not everything goes on the scale. The Ministry's rate list includes:

  • 19% - capital gains (selling shares, units, derivatives), most interest and dividends, and income from selling real estate outside the five-year exemption
  • 20% - certain income of tax non-residents
  • 12% - small civil-law contracts: umowa zlecenia or umowa o dzieło with a non-employer where the contract amount does not exceed 200 zł
  • 8.5% up to 100,000 zł, 12.5% above - private residential rental taxed on the ryczałt (flat rate on revenue), with no cost deductions

If you run a business you can also opt out of the scale entirely (linear 19% or the ryczałt on recorded revenue), but that is a separate decision with its own trade-offs.

Married couples: joint filing

Spouses can file one joint return, which halves the tax when one partner earns much more than the other: the combined income is split in two, taxed on the scale, and doubled. Under the Ministry's Twój e-PIT guidance, joint filing is available only to spouses with marital community of property - a separation-of-property agreement rules it out. You can also file jointly with a spouse who died during the tax year (or after it ended but before filing). Rental income taxed on the ryczałt does not block a joint return. In Twój e-PIT you always get an individual draft first; switching to joint filing is your choice.

Top earners: the 4% solidarity levy

On top of the scale, income above 1,000,000 zł a year carries the solidarity levy (danina solidarnościowa): 4% of the excess over one million, reported on form DSF-1.

Frequently asked questions

### I earn less than 30,000 zł a year. Do I still file a return?

Yes - if your employer collected advances during the year, the annual return is how you get them refunded. The tax-free amount is settled through the return, not assumed in advance.

Is the 32% rate charged on my whole salary once I pass 120,000 zł?

No. Only the part of your tax base above 120,000 zł is taxed at 32%. The first 120,000 zł stays on the 12% bracket terms - the formula "10,800 zł plus 32% of the excess" is just the arithmetic shortcut for the same thing.

Can I file jointly if we signed a separation-of-property agreement?

No. The Ministry's guidance is explicit: joint filing is reserved for spouses in marital community of property.

Does the 4% solidarity levy replace the 32% rate?

No - it is charged in addition. Income above 1,000,000 zł pays the regular scale tax plus 4% of the amount over the million.
