A foreign spouse of a Polish citizen does not always need a work permit in Poland, and in some cases the right to work starts before the residence card is issued. The Chief Labour Inspectorate (Główny Inspektorat Pracy) explained this in a note on the government returns portal, dated as of 13 October 2026. The rule is narrower than many people assume, so this guide sets out exactly what the note says. Status as of 15 October 2026.

The rule in the law

According to the note, article 3, paragraph 1, point 2 of the act of 20 March 2025 on the conditions for entrusting work to foreigners gives free access to the Polish labour market to a foreigner who is a family member of a Polish citizen and is staying with that citizen in Poland. In that case no work permit is needed.

Who counts as a family member here

The note points to the definition in article 2, point 4(b) of the act of 14 July 2006 on the entry into, residence in and departure from Poland of citizens of EU member states and their family members. For a family member of a Polish citizen who is a non-EU foreigner, this includes the spouse of the Polish citizen, but only if all of these conditions are met together:

  • Immediately before coming to Poland, the Polish citizen had a right of residence of over three months, or permanent residence, in another EU member state, an EFTA state that is party to the EEA agreement, Switzerland or the United Kingdom.
  • The marriage was concluded before that stay in another country or during it.
  • The Polish citizen intends to settle in Poland again permanently.

So the note describes a Polish citizen returning to Poland after living elsewhere in Europe, with a foreign spouse. It does not say that every foreign spouse of every Polish citizen is covered by this route. If your situation differs, for example the Polish spouse has always lived in Poland, the note does not answer your case and you should check your own route with the voivodeship office or a lawyer.

When the right to work starts

The question the note answers is whether the right starts on entry, after filing a residence application, or only after getting the card. According to the note, the law does not make the right depend on filing for a residence card or on getting one. It depends on meeting the conditions in the provision. If they are met, the note says it can be assumed that the foreign spouse gets the right to work without a permit from the moment the joint stay in Poland with the Polish citizen begins, provided the stay is legal and the family-member conditions are fulfilled.

How to show it before the card arrives

The note says that before the residence card is issued, the foreigner can show they meet the conditions with documents such as:

  • an identity document,
  • proof of marriage,
  • proof of the spouse's Polish citizenship,
  • proof of the joint stay in Poland,
  • proof that the stay is legal, in particular a valid travel document,
  • a foreign marriage certificate with a translation into Polish.

The note is an information answer from the labour inspectorate. It is not a ruling on your individual case, and an employer may still ask for more. Keep copies of all documents.

What to do next

1. Check if your situation matches the three conditions above. 2. If it does, collect the documents listed and give your employer copies. 3. Ask the voivodeship office dealing with foreigners about your residence card route. Our guide on family reunification covers the residence side.
