Umowa o Prace vs Zlecenia vs o Dzielo: What Changes for You

Short answer: An employment contract (umowa o prace) gives full ZUS insurance, paid leave and Labour Code protection. A mandate contract (umowa zlecenia) insures you but sickness cover is voluntary; a contract for result (umowa o dzielo) has no insurance. Minimum 2026 pay: 4,806 zl/month or 31.40 zl/hour.

Polish job ads throw three contract types at you: umowa o pracę (employment contract), umowa zlecenia (mandate contract) and umowa o dzieło (contract for a specific result). They are not interchangeable labels for the same job - the choice decides how much social security you build up, whether you get paid leave, and how easily the relationship can end. Here is what changes with each one, based on ZUS and Ministry of Labour guidance current in 2026.

The three contracts, one paragraph each

Umowa o pracę is the employment contract under the Labour Code. It is the only one that makes you an employee: working time rules, paid annual leave, notice periods and sick-pay rights all attach to it, and it cannot be swapped for a civil-law contract when the work is really done under the employer's direction, at a set time and place.

Umowa zlecenia is a civil-law mandate contract under the Civil Code: you commit to performing tasks or services. It is common for students, part-time gigs, and project work. It carries social insurance, but less than employment.

Umowa o dzieło is a contract for a defined result - a report, a translation, a built shelf. ZUS warns it is frequently misused for what is really ongoing task work, and courts reclassify such contracts; a series of lectures, for example, has been ruled services, not a "result".

What ZUS takes from each

This is where the real difference sits. Under ZUS's rules on insurance coverage:

  • Umowa o pracę: mandatory pension (emerytalne), disability (rentowe), accident (wypadkowe) and sickness (chorobowe) insurance, plus health insurance. The full package, always.
  • Umowa zlecenia: mandatory pension, disability and accident insurance, plus health insurance - but sickness insurance is voluntary. Skip it and you have no right to sick pay or most maternity benefits from this contract.
  • Umowa o dzieło: no social or health insurance at all. You accrue no pension rights, no sickness cover and no health cover from it. ZUS notes you can only join pension and disability insurance voluntarily if you have no other title to mandatory insurance.

The exceptions that trip people up

Students and pupils under 26 pay no social contributions on umowa zlecenia - ZUS simply does not cover them. That makes zlecenia cheap for employers hiring students, and means a student earns nothing towards a pension from it.

A zlecenia with your own employer (or for a third party but on your employer's behalf) is treated like employment for insurance: full mandatory coverage, including sickness and health, on both contracts combined.

More than one title to insurance changes the picture. If you already have a full-time job at at least the minimum wage, a zlecenia with a different employer generally keeps only health insurance mandatory - no second set of pension contributions. ZUS publishes separate "convergence of titles" rules for the details.

The money floors in 2026

Both employment and zlecenia have legal minimum pay:

  • Umowa o pracę: the monthly minimum wage, 4,806 zł gross from 1 January 2026.
  • Umowa zlecenia: the minimum hourly rate, 31.40 zł gross from 1 January 2026. Per the Ministry of Labour, it is a nationwide rate with no regional or sectoral variation, and it also covers the self-employed who hire no one.

Umowa o dzieło has no minimum rate - the price is whatever you negotiate for the result.

Day-to-day rights

Paid annual leave, public-holiday rules, protected notice periods, limits on overtime and most Labour Code protections exist only under umowa o pracę. A zlecenia can be ended on whatever terms the contract itself sets, and an o dzieło ends when the result is delivered. If your "zlecenia" looks like a job - fixed hours, fixed place, under direction - the National Labour Inspectorate can treat it as one.

Frequently asked questions

### Can I ask for sickness insurance on a zlecenia?

Yes - it is voluntary, and you join through your zleceniodawca. Without it, sick leave on this contract is unpaid and builds no benefit rights, so if it is your only income it is usually worth having.

I am a student under 26 with a zlecenia. Is anything deducted?

No social insurance contributions, because ZUS does not cover you at all. Tax still applies as usual. The trade-off: no pension accrual and no health cover from the contract.

Is umowa o dzieło ever the right choice?

For a genuinely one-off deliverable - a design, an article, a piece of code with a defined result - yes. For recurring shifts or ongoing duties, both ZUS guidance and court rulings say it is the wrong contract.

Which contract is best for me?

For a single main job, umowa o pracę gives the strongest protection: full insurance, paid leave and notice rights. Zlecenia suits genuinely flexible or secondary work; o dzieło suits deliverables. If an employer insists on a civil contract for a fixed-hours role, that is a warning sign.
