Special Educational Needs in Poland: Orzeczenie, Poradnia, IPET

Short answer: Children in Poland with disabilities or health conditions blocking attendance can get an official certificate from a public poradnia team. It obliges the powiat to provide the recommended form of special education, the school builds an individual programme around it, and parents can appeal within 14 days.

Primary School No 20 in Gdynia - special education certificates oblige local authorities to provide the recommended schooling

If your child struggles at a Polish school because of a disability, a health condition or serious learning difficulties, the education system has a formal support track that ends with an official certificate - the orzeczenie o potrzebie kształcenia specjalnego. This guide explains how it works, based on the consolidated text of the Education Law (Prawo oświatowe), Dz.U. 2026 poz. 820, current as of October 2026.

Who qualifies for special education?

Under art. 127 of the Education Law, special education (kształcenie specjalne) covers children and young people who are disabled, socially maladjusted or at risk of social maladjustment, and who need special organisation of learning and working methods. It can be delivered in mainstream schools and preschools, integration units, special schools and units, or specialist centres.

Separate from that, children whose health prevents or seriously hinders attending school can be covered by individual teaching (indywidualne nauczanie) - the school organises it, and since a recent amendment parents can even ask for it to run online in individual contact with teachers.

The certificate: orzeczenie o potrzebie kształcenia specjalnego

The key document is issued by an assessment team (zespół orzekający) in a public psychological-pedagogical counselling centre - the poradnia psychologiczno-pedagogiczna, including specialist poradnie (art. 127 ust. 10). The same teams issue:

  • certificates on the need for special education, which state the recommended form of schooling for the type of disability, including the level of intellectual disability
  • certificates on the need for individual teaching or individual preschool preparation
  • opinions on the need for early development support (wczesne wspomaganie rozwoju, WWR) for a young child
  • certificates for revalidation classes organised under mental-health rules

Private poradnie may only issue a narrower opinion on adjusting educational requirements for a pupil with specific learning difficulties (for example dyslexia), and only if they are properly established and staffed (art. 127 ust. 11, art. 168).

What the certificate unlocks

The certificate is the key to concrete duties of the local authorities:

  • on the parents' application, the starosta (head of the powiat) where the child lives must ensure the recommended form of special education, matching the type of disability (art. 127 ust. 13)
  • if the home powiat runs no suitable special school or centre, the starosta directs the child to the nearest powiat that has one with free places - and that powiat cannot refuse the child (art. 127 ust. 15)
  • the school's director organises individual teaching for a pupil holding that certificate, in agreement with the running authority

Inside the school, the programme is adapted to the pupil through an individual educational-therapeutic programme (indywidualny program edukacyjno-terapeutyczny, IPET), which takes into account the recommendations in the certificate (art. 127 ust. 3).

Early support for the youngest children

From the moment a disability is detected until the child starts school, early development support (WWR) can be organised in preschools, schools, centres and poradnie, delivered directly with the child and the family. The gmina may also organise free transport for the child and a carer to the place where the support is provided (art. 127 ust. 5-7).

If you disagree: 14 days to appeal

Parents can appeal a certificate to the regional education superintendent (kurator oświaty) within 14 days of receiving it (art. 127 ust. 12). Do not miss that deadline - it runs from the day you receive the document, not from the appointment.

What this means for expat families

The right to special education does not depend on citizenship. If your child is enrolled in the Polish system and you suspect a disability or a condition that blocks normal attendance, ask the public poradnia in your district about an assessment. The certificate then works for you in two directions: it obliges the local authority to provide the recommended form of schooling, and it obliges the school to build the IPET around your child's needs.

Frequently asked questions

### Who issues the orzeczenie in Poland?

Only assessment teams in public psychological-pedagogical counselling centres (poradnie psychologiczno-pedagogiczne) issue certificates on the need for special education, individual teaching and early development support. Private poradnie may only issue the narrower opinion on adjusting requirements for specific learning difficulties.

My child's Polish is weak. Does that count as a special educational need?

No - language support for foreign children is a separate track (free Polish lessons and preparatory units; see our guide). The orzeczenie covers disabilities, social maladjustment and health conditions requiring special organisation of learning. A child can of course qualify for both tracks at once.

What if the certificate recommends a school our district does not have?

Your starosta must direct the child to the nearest powiat that runs a suitable special school or centre with free places, and that powiat cannot refuse admission.
