How to Cancel a Gym or Phone Contract in Poland - in English

The essentials: Contracts signed online or off-premises carry a 14-day no-reason withdrawal right, in any written form - English is fine. Gym lock-ins hidden in small print are challengeable (UOKiK charged Benefit Systems in January 2026), and rolled-over phone contracts end with one month's notice, keeping your number.

A row of empty treadmills in a gym - cancelling a Polish gym membership is a written process

Cancelling a contract in Poland can feel like a boss fight designed for native speakers: call centres in Polish, regulations in legalese, and front-desk staff who suddenly cannot help you in English. The good news is that Polish consumer law is genuinely strong, most cancellations can be done entirely in writing - and a written statement in English is legally valid. This guide walks through cancelling the two contracts expats wrestle with most: a gym membership (karnet) and a phone or internet plan, using the current rules from UOKiK (the competition and consumer authority) and UKE (the telecoms regulator).

Your strongest tool: the 14-day cooling-off period

If you signed the contract at a distance - online, by phone - or off-premises, for example from a salesperson at your door or a stand in a shopping mall, you can withdraw within 14 days without giving any reason and without any penalty. For an unsolicited visit or "excursion" sale the window extends to 30 days. For a gym pass bought through the club's website, that 14-day window is your clean exit if you acted fast.

The clock starts on the day the contract was concluded for services. To withdraw, you submit a statement - and here is the part expats miss: the form is completely free. No official Polish-language template is required. UOKiK confirms the statement can be formulated by you, in any form; for evidence, do it in writing. If the trader accepts withdrawals electronically, for example through a form on its website, it is legally obliged to confirm receiving it, typically by email. That is Article 30 of the Consumer Rights Act.

Two practical notes. First, the cooling-off right does not apply to contracts signed inside the trader's own premises - a phone plan signed in the operator's salon or a karnet bought at the gym's front desk follows the ordinary termination rules below instead. Second, if you already used the service during the 14 days, the trader may charge a proportionate amount for what was delivered.

Cancelling a gym membership

A gym pass, fitness membership or yoga card is a contract: you commit to pay, the club commits to provide the service for a set period. What you can do depends on what you signed, but Polish law puts real limits on what clubs may hide in the small print.

Clauses in the regulations that are contrary to good practice and grossly harm consumers - so-called prohibited clauses (klauzule niedozwolone) - are simply invalid, even if you clicked "accept". This is not theory. On January 21, 2026, the President of UOKiK brought formal charges against Benefit Systems, the company behind gym networks including Zdrofit, Fabryka Formy, Fitness Academy, My Fitness Place, FitFabric, Step One, Total Fitness, Saturn Fitness and Interfit Club. The allegation: marketing that shows a promotional monthly price while hiding the actual contract terms - including a 12-month commitment with no right to resign early - behind scrolls, icons and downloadable documents. UOKiK cited complaints from customers who bought what was presented as a no-commitment monthly plan and were told about the annual lock-in only when they tried to cancel.

So before you accept "you cannot cancel", check three things. One: is the clause they rely on actually in the contract terms you were shown before buying, or buried in a regulation you never saw? Hidden lock-ins are exactly what UOKiK is now challenging. Two: is the club delivering the service? If classes are cancelled, equipment is broken or trainers do not show up, you have rights as a consumer of a faulty service - UOKiK's May 8, 2026 guidance for gym customers covers precisely these situations. Three: did the club itself change the terms, close your location or move your classes? A material change on their side opens the door to exit.

To cancel: send a written termination statement (wypowiedzenie) to the operator - email to the address in your contract, or a letter. State your name, membership number, that you are terminating the contract, and from when. Ask for written confirmation. Keep everything.

Cancelling a phone or internet contract

Telecoms contracts follow the Electronic Communications Law (Prawo komunikacji elektronicznej) of July 12, 2024, and UKE's consumer guide "Masz prawo!" spells out the rules in plain language.

Distance-signed contracts carry the same 14-day free withdrawal as above. For everything else: any contract can be terminated with the statutory or contractual notice period. If you end a fixed-term contract before it expires, the provider may charge the contractual penalty stated in your terms - that is the legitimate cost to check before you pull the plug, not a reason you "cannot" leave.

The structural protections matter more for most expats. Your first fixed-term contract with a provider cannot exceed 24 months. If a provider offers fixed-term contracts at all, it must also offer you the option of a contract of up to 12 months. When your fixed term ends and the contract rolls over automatically into an open-ended one, you can terminate it at any time with one month's notice - you simply keep paying the subscription during that notice month. The provider must also inform you, no later than 30 days before your contract ends, about the automatic extension, the ways to terminate, and the most advantageous tariff packages it offers.

Cancelling does not cost you your phone number. You keep the right to port your number to another network during the notice period, and your new provider must activate the service no later than one day after the old contract ends. For internet, you have a right to continuity: an overlap of at least one month between the old and new service if you switch.

A Polish SIM card - porting your number to a new network is a legal right during the notice period

Doing it all without speaking Polish

Everything above can be done in writing, in English. The statement form is free, and a clearly worded English email creates better evidence than a nervous phone call in broken Polish. Four habits make it work:

Put it in writing and keep proof. Email the address given in your contract for notices, or send a registered letter (list polecony) from any post office - the receipt is your proof of the date. Electronic withdrawals must be acknowledged by the trader; if no confirmation arrives within a few days, send again and keep both.

Use simple, formal wording. You do not need legal Polish. For example: "I hereby withdraw from the contract No. [number] concluded on [date] within the 14-day statutory period. Please confirm receipt of this statement." For a termination: "I hereby terminate my contract No. [number] with effect from the end of the statutory notice period. Please confirm in writing." Both are valid statements.

Refuse the retention maze in writing too. If a gym or operator replies that you must call, visit in person or fill an internal form, answer - in writing - that you have submitted a valid statement and expect written confirmation. For distance contracts, Article 30 obligations sit on their side.

Escalate for free, in English if needed. Every city and district has a municipal or district consumer ombudsman (Miejski/Powiatowy Rzecznik Konsumentów) who advises consumers free of charge and can intervene with the trader on your behalf. UOKiK also runs a free consumer advice line at 801 440 220 and 22 266 76 76 and the dlakonsumentow.pl portal. For cross-border purchases from other EU countries, the European Consumer Centre (ECK) helps in English.

Frequently asked questions

Can I cancel a Polish gym membership within 14 days?

Yes - if you bought the pass online, by phone or from a salesperson outside the club, you can withdraw within 14 days without giving a reason, in any written form. Passes bought at the gym's own front desk do not carry this right; they follow the contract's termination terms. My gym says my membership is a 12-month contract I cannot leave. Is that legal?

Possibly - but check how it was sold. UOKiK's President brought charges against Benefit Systems in January 2026 for promoting monthly prices while hiding the 12-month lock-in; clauses that grossly harm consumers are invalid even when accepted. A municipal consumer ombudsman can review your contract for free. Source: UOKiK, "Karnet na siłę? Prezes UOKiK stawia zarzuty Benefit Systems", January 21, 2026.

How much notice does a Polish phone contract need?

Once a fixed-term contract has rolled over into an open-ended one, you can terminate at any time with one month's notice. Ending a fixed-term contract early can trigger the contractual penalty in your terms, so check that figure first. Will I lose my phone number if I cancel?

No. You keep the right to port your number to a new network during the notice period, and the new provider must activate service no later than one day after the old contract ends.
