Notary Fees for Buying a Flat in Poland: Maximum Rates
Short answer: The notary fee is capped by regulation. For a flat the cap is half the general scale: at most 1,585 PLN on a 600,000 PLN flat, as of October 2026.

If you buy a flat in Poland, the sale has to be signed in front of a notary (notariusz) as a notarial deed. The notary's fee is the first cost most buyers ask about. The good news is that it is capped by a regulation of the Minister of Justice, so you can work out the maximum before you walk into the office. This guide uses the consolidated text of that regulation (Dz.U. 2024 poz. 1566) and shows the maths with examples, as of October 2026.

What the cap means
The regulation sets maximum rates (stawki maksymalne), not fixed prices. Under the rules, the fee is always agreed with the client and can be lower than the maximum. The notary does not have to charge the top rate, so it is fair to ask for the quote in writing before you book.
The value used to calculate the fee is the value stated by the parties to the transaction. The regulation says that mortgages and discounts are not deducted when the value is calculated.
The scale for the general rate
The table of general maximum rates (§ 3 of the regulation) works in bands. For the value of the transaction:
- up to 3,000 PLN: 100 PLN
- 3,000 to 10,000 PLN: 100 PLN plus 3% of the amount above 3,000
- 10,000 to 30,000 PLN: 310 PLN plus 2% of the amount above 10,000
- 30,000 to 60,000 PLN: 710 PLN plus 1% of the amount above 30,000
- 60,000 to 1,000,000 PLN: 1,010 PLN plus 0.4% of the amount above 60,000
- 1,000,000 to 2,000,000 PLN: 4,770 PLN plus 0.2% of the amount above 1,000,000
- above 2,000,000 PLN: 6,770 PLN plus 0.25% of the amount above 2,000,000, but no more than 10,000 PLN (7,500 PLN between close family in the first tax group)
The half rate for flats
For many housing transactions the regulation cuts the maximum to half of the general rate. The list in § 6 includes the sale of a residential flat, a developer agreement (umowa deweloperska), setting up a separate ownership of a flat and transferring it to the buyer, and setting up a mortgage. It also covers the sale of a plot that qualifies as building land and the transfer of a single-family house in the cases the regulation names. So for a typical flat purchase, the cap is half of the scale above.
Worked examples
These are maximums for the notarial deed of sale of a flat, using the half rate. They are our own arithmetic from the regulation, not quotes from a notary.
- Flat worth 400,000 PLN: general rate 1,010 + 0.4% of 340,000 (1,360) = 2,370 PLN. Half: 1,185 PLN.
- Flat worth 600,000 PLN: general rate 1,010 + 0.4% of 540,000 (2,160) = 3,170 PLN. Half: 1,585 PLN.
- Flat worth 1,000,000 PLN: general rate 1,010 + 0.4% of 940,000 (3,760) = 4,770 PLN. Half: 2,385 PLN.
Check whether the quote you get is net or gross of VAT, and ask what else is included. Other costs of a purchase, such as the court fee for the land and mortgage register and the tax on the transaction, are separate. For the tax, see our guide to the PCC tax on buying a flat or car.
Foreign buyers
Notary rules are the same for everyone, but a non-EU buyer may need a separate permit to buy property. See can foreigners buy property in Poland before you sign a preliminary agreement. If you do not speak Polish, ask the notary whether a sworn translator will be needed at the signing, and who pays.
A change may be coming
In July 2026 the Ministry of Justice published a draft amendment of the regulation, reported by the daily Rzeczpospolita. The draft would raise flat-rate fees, for example the maximum for a will from 50 to 200 PLN, and change the top of the scale: a new band above 5,000,000 PLN with a cap of 25,000 PLN. We found no sign that it had entered into force as of 13 October 2026, and the consolidated text we checked is still the 2024 one. If a new regulation is published, the numbers above will change, so check the current text on the government legal portal before you rely on them.
Frequently asked questions
Is the notary fee fixed in Poland?
No. The regulation sets a maximum. The actual fee is agreed with the client and may be lower.
How much is the notary fee for a 600,000 PLN flat?
By our calculation from the regulation, the maximum is 1,585 PLN for the deed of sale at the half rate. Ask for a written quote, and check whether VAT is included.
Does a mortgage change the value used for the fee?
No. The regulation says that mortgages and discounts are not deducted when the value of the transaction is calculated.
Does the cap apply to foreigners too?
Yes, the regulation does not make a distinction by nationality. A foreigner may still need a permit to buy, which is a separate matter.
Are the fees going up?
A draft amendment published in July 2026 would raise some of them. As of 13 October 2026 we found no evidence that it is in force.
