PESEL or NIP: Which Tax Number Do You Need in Poland?
Short answer: Most expats never need a NIP: a natural person who is not a registered VAT payer and does not run a business uses their PESEL as the tax identifier. You need a NIP when you register for VAT, run a business or must file as a payer without a PESEL - registration is on form NIP-7, online or on paper.

Two numbers follow you around Polish officialdom: PESEL and NIP. Most expats only ever need one of them - and the wrong assumption about which one causes real paperwork pain. This guide is based on the consolidated Act on the Rules of Registration and Identification of Taxpayers and Payers (Dz.U. 2026 poz. 151), the official podatki.gov.pl forms page (updated 8 October 2026) and the gov.pl service guidance, current as of October 2026.
The basic rule: PESEL is your tax number
Under art. 3 of the registration act, the tax identifier for a natural person is their PESEL number - as long as they are not a registered VAT payer and do not run a business. This also covers people running small unregistered activity (działalność nierejestrowana) under the Entrepreneurs' Law.
In practice this means:
- employees, contractors (umowa zlecenia) and most freelancers without a registered business use PESEL on tax matters
- your PIT annual return, your employer's payroll and ZUS all key off PESEL
So if you are an ordinary worker in Poland, you never apply for a NIP - your PESEL already is your tax identifier.
When you actually need a NIP
NIP is the identifier for the remaining subjects obliged to register (art. 2 and art. 3 of the act). For an expat, NIP enters the picture when you:
- register as a VAT payer (including as a freelancer or business owner)
- run a registered business (JDG) - the NIP is assigned through the CEIDG registration
- are a payer (płatnik) - for example when you employ someone and must remit their advance income tax, or when you pay certain taxes that require registration, such as a PCC-3 or SD-Z2 filing, and you have no PESEL
Foreigners without a PESEL who must make a tax filing register with the tax office on form NIP-7.
Form NIP-7: the registration form
NIP-7 is the identification (and update) form for a natural person who is a taxpayer or payer. The current version on podatki.gov.pl is NIP-7 (7). You can file it:
- online in e-Urząd Skarbowy, signing with a trusted profile, electronic banking or the mObywatel app
- online with a qualified certificate
- on paper at your tax office
Two sibling forms matter too: NIP-2 for legal persons and organisations, and ZAP-3 for updating a natural person's data such as a change of address.
Getting the PESEL side right
Many expats hear "you need a NIP" when what they actually need is a PESEL. The gov.pl guidance for foreigners is clear:
- register your address (zameldowanie) for a stay over 30 days - the PESEL is assigned automatically
- if you cannot register but an office (for example ZUS or the tax office) requires a PESEL, file an application at the gmina office - it is free of charge
- if you cannot register and have an employer in Poland, apply at the gmina office for your employer's seat; if you do not work or your employer is abroad, apply at the Śródmieście district office in Warsaw
The office should also tell you the legal basis it relies on - and you enter that basis in the application.
Common mistakes
- applying for a NIP "just in case" as an employee - unnecessary; PESEL is your identifier
- filing a PCC-3 or SD-Z2 without any identifier as a foreigner - register with NIP-7 first
- forgetting to update your data: address changes for natural persons go on ZAP-3, identification data updates on NIP-7
- assuming your landlord's or employer's copy of your number makes it official - registration is always personal

Frequently asked questions
### I work on an employment contract. Do I need a NIP?
No. Under art. 3 of the registration act, a natural person who is not a registered VAT payer and does not run a business uses their PESEL as the tax identifier. Your employer and ZUS use the same number.
I am a freelancer with a registered JDG. Which number do I use?
A registered business gets a NIP through the CEIDG registration. That NIP - not your PESEL - is your identifier for business taxes and VAT.
How do I register if I have no PESEL but must file an inheritance or PCC tax form?
File form NIP-7 with the tax office - online in e-Urząd Skarbowy with a trusted profile, banking login or mObywatel, or on paper. You will receive a NIP that you then use on the SD-Z2 or PCC-3 filing.
