Bought a Used Car in Poland? The Seller's OC Will Not Auto-Renew
The essentials: Valid compulsory OC passes with a used car, but the inherited policy does not renew automatically. Confirm its expiry and remaining premium with the insurer, and arrange replacement cover without a gap.

Buying a used car in Poland can leave you holding an insurance document with somebody else's name on it. That is not automatically a problem. Valid compulsory third-party liability insurance, called OC, normally passes to the buyer with the vehicle. The dangerous assumption is that it will keep renewing, or that the seller's price is necessarily your final cost.
This guide covers taking over an existing Polish OC policy when buying a used vehicle. It is not a quotation, an assessment of a particular policy, or a guide to importing an uninsured car. Check the insurer's confirmation and your own documents before driving. The rules below were checked against the Financial Ombudsman's guidance and insurer information on 5 November 2026.

Before handing over the money
Ask the seller for the actual OC policy, not merely an insurance offer, a quotation or a proposed contract. Compare the vehicle details with the sale agreement and registration document. Keep the policy number, insurer's name, expiry date and any payment schedule together with your purchase papers. A document that once showed valid cover may no longer describe the current position.
Use the Ubezpieczeniowy Fundusz Gwarancyjny, or UFG, service to check OC on the day of purchase. The official service supports a registration number or VIN. Its purpose is to establish whether a vehicle is insured for the date checked; it is not a personal quotation for the buyer. Save the result and ask the insurer to clarify any disagreement between that result and the seller's papers.
Do not assume an old certificate settles a conflicting or missing result. Equally, do not diagnose the cause of an unclear database result yourself. Recheck the vehicle identifiers and contact the named insurer. The Financial Ombudsman says that if the vehicle has no valid OC, the buyer must arrange it no later than the purchase day, including weekends. Do not use the car until cover is in place.
What passes to you automatically
The Financial Ombudsman explains that the rights and duties under the seller's compulsory OC transfer by law when the vehicle is acquired. You do not have to sign a new insurance contract just to make that transfer happen. Notification is still important for accurate records, but it is not what creates the automatic transfer.
That transfer includes obligations as well as protection. There may be unpaid instalments or a later recalculation of the premium for the remaining period. A seller saying that insurance is included does not establish that every payment has been made. Ask for payment details and obtain the insurer's own answer about what remains payable after your acquisition.
Keep the distinction between OC and optional products clear. Autocasco, assistance and personal accident cover are separate questions. PZU describes certain benefits for its own products, but you should not treat one insurer's package as a rule for every policy in Poland. Ask specifically which optional protections, if any, continue after the change of ownership and obtain their terms.
Your first call to the insurer
Contact the insurer using details from its official website or policy documents. Explain that you acquired the vehicle and give the acquisition date, registration number, VIN and policy number. Ask how to update the holder's details and what evidence of the transfer it needs. Keep a copy of the agreement ready without sending it to an unverified address.
Ask for clear answers to four questions: Is this policy currently valid? What exact date does cover end? Are there remaining instalments attributable to the period after purchase? Will the insurer recalculate the premium for the new holder? A general assurance that the car is insured does not answer all four.
Useful Polish wording is: Kupiłem samochód z polisą OC poprzedniego właściciela. Proszę potwierdzić ważność, datę końca ochrony i pozostałą składkę. This means: "I bought a car with the previous owner's OC policy. Please confirm validity, the end date of cover and the remaining premium." Add your policy number through the insurer's secure channel, not a public comment or social-media post.
Recalculation can change the price
The insurer may recalculate the premium using the new holder's risk profile, including driving experience and claims history. The Financial Ombudsman notes that a recalculation can mean an additional charge, but it can also work in the buyer's favour. The amount is not something a general guide can predict from the seller's annual premium.
Importantly, the Ombudsman says the rules do not set a deadline by which the insurer must carry out that recalculation. A demand arriving later is therefore not automatically invalid just because several months passed. Ask for the calculation, the period covered and the reason for the adjustment before deciding whether it is correct.
You can ask the insurer to recalculate early instead of waiting for a surprise. Compare the confirmed remaining cost of continuing the inherited policy with a new policy that meets your needs. Compare matching periods and products, not a short remaining balance against a full year's quotation. Insurer or broker statements about what they usually do are not a guarantee about your contract.

The inherited policy does not renew itself
This is the central trap. An OC policy taken over from the previous holder does not automatically renew for another year. You may continue it until its valid end date, but you must arrange replacement cover in time. Do not rely on the automatic-renewal habit you had with a policy you purchased yourself.
Record the expiry date as soon as you receive confirmation from the insurer. Set your own reminder with enough time to compare offers and finish payment or identity checks. A quotation sitting in an email is not evidence that a new contract is active. Check the issued policy and the start of responsibility before treating the job as finished.
If the inherited policy is short-term, sometimes described as a dealer or komisowe policy, do not assume it has a full year left. Verify the actual dates. Nor is simply leaving a normally registered vehicle parked a substitute for maintaining compulsory cover. If you think a special exemption applies, check that specific legal situation rather than inferring one from not driving.
Changing insurer without creating a gap
You can terminate the inherited policy rather than keep it until expiry. But buying another policy is not the same as notifying the old insurer, and simply ignoring a bill does not communicate a valid termination. Arrange the replacement and the end of the inherited contract deliberately.
Since 10 September 2025, the rules allow the acquirer to specify a future termination date. If the notice gives no date, the insurer treats the notice date as the termination date, according to the Financial Ombudsman. That is why an improvised message saying "cancel this" can be a costly mistake. Ask the insurer to confirm the effective date and ensure the replacement begins without any break.
The Ombudsman recommends having the new contract arranged before submitting termination. Do not use the future-date option as permission to postpone arranging cover. Confirm both contracts' boundaries in writing, especially when submitting late in the day or through a channel that needs manual handling. A small overlap needs checking, but an uninsured gap must not be your method of avoiding two premiums.
A normal email is not the same as a signed notice
The Ombudsman's updated guidance says the written-form requirement for OC termination remains. A handwritten signature on the notice matters. A signed document can be sent by traditional post or as a scan to the insurer's email address; an ordinary unsigned email saying you terminate is not enough to satisfy that written-form requirement.
Use the insurer's own instructions and current form. If it offers an online process, check what signature or document step completes it, rather than assuming a typed name is sufficient. Keep the signed notice, proof of sending or submission, and the insurer's confirmation. Consent to receive the insurer's correspondence electronically does not remove the separate form requirements for your own termination notice.
What the seller must do, and what you should keep
The seller must hand over confirmation of OC and notify the insurer of the transfer within 14 days, including the buyer's details. That is separate from vehicle registration formalities. As the buyer, do not wait passively for the seller to make your records correct: contact the insurer yourself and retain evidence of the date you became the holder.
If you terminate the inherited contract, the refund for the unused part generally belongs to the person who concluded that contract, normally the seller. Do not budget for receiving that refund yourself without a clear contractual basis and insurer confirmation. Likewise, a private understanding between buyer and seller does not replace the insurer's calculation of the premium obligations.
Keep one folder containing the sale agreement, OC document, UFG result, payment information, correspondence, any signed termination and your replacement policy. If a later demand looks wrong, these records make it possible to explain the timeline. Ask the insurer for a written explanation and use its complaint process where necessary; the Financial Ombudsman is an official source of guidance if the dispute remains unresolved.
A practical handover checklist
Before purchase, verify the car and policy identifiers and check OC for the acquisition day. Before driving, establish valid cover. After purchase, update the insurer's records, request the remaining-payment position and decide whether to continue or replace the inherited policy. Before expiry or termination, obtain active replacement cover with no gap.
Treat registration, purchase tax, technical inspection and insurance as separate tasks. Completing one does not prove the others are finished. Our used-car buying guide covers the wider purchase, and the vehicle registration guide explains that separate process. For OC, the best endpoint is simple: confirmed current cover, understood remaining cost, and a recorded replacement deadline.
Frequently asked questions
Can I drive with the seller's name on the OC policy?
Valid compulsory OC normally transfers with ownership. Verify that the policy is actually active, identify the vehicle correctly and update the insurer's records. Do not rely on a quotation or an outdated certificate.
Will inherited OC renew automatically?
No. Arrange a new policy in time for the end of the inherited cover. The automatic-renewal rules for a policy you bought yourself should not be assumed to apply.
Can the insurer ask me for more money later?
It may recalculate the remaining premium for your risk profile, and unpaid instalments can matter. Request the calculation and relevant period. The Financial Ombudsman says no specific recalculation deadline is set by the rules.
Is an unsigned email enough to cancel the inherited policy?
The Financial Ombudsman says ordinary unsigned email is not enough for the written-form requirement. Use a signed notice and the insurer's accepted submission route, keeping proof and confirmation of the effective date.
