If you buy a flat or house in Poland, a small annual bill follows: podatek od nieruchomosci, the local property tax. It is modest for homes but very different for business premises, and the caps rise every year with inflation. As of October 14, 2026, these are the rules and the maximum rates for 2026, from the Local Taxes and Fees Act (consolidated text: Journal of Laws 2025, item 707) and the Finance Ministry's annual announcement (Monitor Polski 2025, item 726).

Who pays property tax in Poland

Under Article 3 of the Act, the taxpayer is:

  • the owner of the property or building,
  • an autonomous possessor (someone holding property as if they owned it),
  • a perpetual usufruct holder of land (uzytkownik wieczysty) - common for land under apartment buildings in cities,
  • in some cases, the possessor of state or communal property.

Tenants do not pay it. If you rent a flat, the tax is the landlord's problem. If you buy a flat, you become the taxpayer for your unit from the first day of the month after you acquire it (Article 6(1)). Foreign owners are treated exactly like Polish ones: there is no nationality distinction in the Act.

2026 maximum rates

The Act fixes only the caps (gorne granice); each municipal council sets its actual rates by resolution, at or below the cap (Article 5(1)). The caps are indexed annually to first-half consumer price inflation and published in Monitor Polski (Article 20). For 2026 (M.P. 2025, item 726), the maximum rates are:

Land, per square metre per year:

  • 1.45 zl - land connected with business activity,
  • 0.77 zl - other land, including the land under residential buildings,
  • 4.72 zl - undeveloped land in revitalization areas zoned for housing where four years have passed since the zoning plan took effect,
  • 7.15 zl per hectare - land under surface waters.

Buildings or parts of buildings, per square metre of usable area per year:

  • 1.25 zl - residential,
  • 35.53 zl - connected with business activity, including the part of a home used for a business,
  • 12.00 zl - other buildings, including garages,
  • 7.27 zl - used for health services,
  • 16.64 zl - used for trading certified seed material.

A 60 m2 flat in a municipality that applies the maximum rates owes 75 zl a year on the building part, plus its share of the tax on the land under the building. In practice many cities charge at or near the cap, but some set lower rates, so check your gmina's resolution.

How your actual bill is set

For individuals, the tax office (the gmina's wydzial podatkow) issues an annual decision (decyzja) setting the amount, based on the property information you file. Individuals must submit a property information form (informacja o nieruchomosciach) to the tax authority within 14 days of the event that creates or ends the obligation - for a buyer, within 14 days of acquiring the property (Article 6(6)). The tax office then calculates the tax; you do not compute it yourself.

The tax is payable in four instalments: by 15 March, 15 May, 15 September and 15 November of the tax year, proportionate to how long the obligation lasts (Article 6(7)). New buyers mid-year pay only for the months they owned.

What this means for expats buying a home

Three practical points:

1. Budget tiny, not zero. A typical flat costs tens of zloty a year in property tax; a detached house with a garden runs into the low hundreds. It will not break your budget, but ignoring the decision letters means interest on arrears. 2. File the form. After the notary signs you over, file the informacja o nieruchomosciach within 14 days. Many buyers discover this obligation only when the first decision arrives with a delay. 3. Business use changes everything. Register a business at your flat and use a room for it, and that part can jump from the 1.25 zl residential rate toward the 35.53 zl business rate. The same applies to land.
